Mortgage Forgiveness Debt Relief Act and What it Means to You

In 2007, Congress passed the Mortgage Forgiveness Debt Relief Act. Due to the number of foreclosures and homes sold as short sales, Congress passed the Mortgage Forgiveness Debt Relief Act so that homeowners facing distressed property sales wouldn't be taxed on the cancelled debt.

What is Cancellation of Debt?
If you borrow money from a lender and the lender later cancels or forgives your debt, you may have to include the cancelled amount in income for tax purposes. The lender is usually required to report the amount of the canceled debt to you and the IRS.

Here is a simplified example: You borrow $200,000 and default on the loan after paying back $100,000. If the lender doesn't collect the remaining debt from you, there's a cancellation of debt of $100,000. This income is generally taxable income to you.

Is Cancellation of Debt income always taxable?

The Mortgage Forgiveness Debt Relief Act expires on December 31, 2012. Therefore, if you are a Seller who may need to sell your property as a short sale, the time to start that process is NOW! Short Sales typically take 4-6 months to process for Lender Approval. While the possibility does exist that the law may be extended, there is no guarantee and time may be running out. As of this writing, your transaction must close on or before December 31, 2012 or you may incur significant tax liabilities.

Tips for Negotiating the Best Offer on Your Home

So, you listed your home for sale and you've received an Offer to Purchase, or perhaps multiple Offers. What is the best way to analyze the Offer? What should your response to the buyer be? Your Realtor can offer you guidance but ultimately the decision is yours to make. In order to help you formulate the best response, below are some helpful tips for negotiating the best offer on your home.

1) Understand how the process works - When you receive an offer, you can accept, reject or respond with a counter offer, which is a modification of the terms they've presented to you.

2) Decide what is important to you - In advance, decide what terms of the sale are most important to you. Perhaps you need a quick closing or maybe you need a certain amount of money to pay off your existing mortgage. Allow yourself to be flexible on as many terms of the Offer to Purchase as you can be. That way, you'll have a higher likelihood of putting the transaction together.

3) Don't take the offer personally - Home buying and selling is an emotional process but put simply, it is a business transaction. If a buyer lowballs and says it's because they need to update the 1940's kitchen and bath, don't be offended. Everyone has different likes and dislikes when it comes to home style, color, flooring, kitchen and bath design, etc. If the buyer is expressing interest in the home, carefully listen to how they've arrived at their purchase price and don't be too quick to discount it.

4) Review all terms of the offer - Often sellers will focus on the purchase price and not carefully consider the other terms of the offer. Is the proposed closing date acceptable? Has a pre-approval letter been attached to the offer so that you know the buyer has the ability to obtain a mortgage? Is the buyer asking for the seller to pay closing costs? Do they want the appliances or drapes? Review the amount of earnest money the buyer intends to deposit in escrow to determine whether it's sufficient to bind them in the transaction.

After reviewing every facet of the Offer to Purchase, determine which ones are acceptable, which ones can be re-negotiated, and which ones are deal breakers.

5) Think outside the box - Let's say you received an offer that is unacceptable. Instead of rejecting it, think about how you can creatively work out the terms of the transaction so that they're acceptable to both parties. Ask questions to help you determine what the buyer needs/wants most from the transaction. Maybe they need to close in a short amount of time. In this case, you might remain firm on your price but offer a quick closing. Perhaps they are moving from out of state and aren't bringing any appliances with them. Offering to include the kitchen and laundry appliances may make a difference. If the buyer was gushing about your custom window drapes, consider including them in the sale but, in turn, stay firm on a component of the transaction that is important to you.

In conclusion, to successfully negotiate the sale of your home, listen carefully to your Realtor, try not to let your emotions get in the way, carefully analyze all terms of the Offer and, most of all, remain flexible and creative!

Pepperell MA - Old Paper Mill Torn Down

After sitting vacant for many years and in very poor condition, the old paper mill, sited on approximately 12 acres in downtown Pepperell, MA, has been torn down. Quite a few proposals have been set forth over the years to develop the site but today's economy has made it a difficult proposition. In hopes of making the site more desirable to investors, the extensive mill site has been reduced to a pile of rubble.

Overlooking the Nashua river and just below a dam on the other side of Main street, the first paper mill was established around 1834 and the Pepperell Paper Company was the final successor to a series of companies that have operated the mills until it closed in 2002.

In the past, plans have been set forth to create a village with a mixed used of commercial and residential buildings. Town officials are commited to economic re-development of the site.

The Disappearing Closing Gift

This past Friday, I had a closing on a marvelous new construction home located in Groton, MA. This lovely cape style home with 2 car attached garage was built by an outstanding builder, Peter Andrews.

As a closing gift, I got the new homeowner a gorgeous hanging basket for their front porch. They absolutely loved it and the husband immediately went out to buy a hook in order to hang it. You can imagine my surprise when the buyer calls me shortly thereafter and says, "Catherine, did you happen to come by and take the plant with you thinking we might not be here this weekend?" I replied, "No, why?" She then goes on to tell me that someone drove directly across the newly seeded lawn, took the plant off of the front porch, and drove off leaving ruts in their new front lawn. This all happened while she was in the house! Groton is a very quiet rural community with a very low crime rate. Who would have the audacity to drive over someone's lawn and take a plant off of their front porch? It was gorgeous but really folks, what kind of message are you sending to your new neighbor when they can't even keep a nice hanging basket on their front porch? Drive over the front lawn? If you're going to tresspass and steal, can you at least use the driveway?

On a similar note, does every town have a "bulb thief"? I was recently at a property that has beautiful perennial flower beds. While I was being given the tour, we noticed that someone had come onto the property, stolen a rare perennial and didn't even have the decency to re-distribute the soil. They left a huge hole and didn't even try to hide the fact that they had obviously been dug up.

So, I'm ready to take a nice neighborhood drive to see who has that hanging flower basket and reclaim it for my client. What would you do?

The good news is that Groton, MA is a lovely town. Rich in history, it still maintains its rural and agriculturally based roots. I'm sure that my client will enjoy living in their new home for many years to come!

Pepperell MA - 2011 Fourth of July Events

When I moved to Pepperell, MA in the summer of 2001, one of the first events that my family and I attended was the Fourth of July Parade and Fireworks. We set up our lawn chairs under a large maple tree on Main Street and proceeded to watch marvelous bands (school, dixie, bag pipes), horse drawn carriages, clowns, antique cars and tractors, boy scouts, local clubs, and others make their way from Town Hall to the VFW. Who doesn't laugh and smile when watching a bunch of grown men scoot around in mini cars? Young children love the parade! Probably for the huge amount of candy that is thrown from parade exhibitors to the kids!

The 2011 Pepperell Fourth of July Events will take place on Saturday, July 2nd beginning at 12:30pm. After the parade, make your way to the Town Field for Live Music On The Bandstand, Tug-A-War, Water Balloon Toss, Sack Race & More as well as Food and Local Business Booths. The evening culminates with one of the best firework displays in the area.
