Homestead Act - Changes Take Effect in March 2011

Important amendments were made in December 2010 to the Homestead Act (Mass. General Laws, Ch. 188) and go into effect on March 16, 2011.  The Homestead Act gives homeowners protection against subsequent attachment, suit, or bankruptcy to the extent of $500,000 of equity per residence, per family.  This legal document, called a Declaration of Homestead, is filed at the registry of deeds, at time of purchase of a primary residence. It's important to note that while a Declaration of Homestead can protect the equity in many cases, tax obligations and child/spouse support obligations are not covered.

One of the most significant changes to the Homestead Act is that homeowners are now allowed to maintain the same Homestead protection on the proceeds of the sale. The protection is available for a period of one year from the time of the sale, or when a new primary residence is purchased, whichever happens first.

If you want to obtain the maximum coverage of $500,000, you need to file the Declaration at the registry of deeds. Otherwise, there will be an automatic coverage amount of $125,000 without filing.

Other changes to the Homestead Act include protection for homes held by a trust, that a new Declaration is unnecessary after refinancing, and it prohibits lenders from requiring a waiver or release of the Homestead.  Lastly, four-family homes will qualify for Homestead protection and closing attorneys must inform buyers of their right to file a Declaration of Homestead.

If you filed a homestead declaration prior to March 16, 2011, your $500,000 protection will continue to apply.

"Desire to Own a Home" Top Motivating Factor for Purchasing a Home in 2010

I recently read a Massachusetts REALTOR® Study Report in which they state that the "desire to own a home" was the top motivating factor cited by home buyers for the purchase of a home in 2010.  Below, is a breakdown of survey responses of first-time and repeat home buyers:

While 55% of all homes sold in Massachusetts were made by first time home buyers, only 7% stated it was because of the home buyer tax credit.

The study also showed that the median age of a first-time homebuyer is 32 vs. 30 years old in 2009.

  

Do home purchasers think that buying a home is a good financial investment?

46% of all buyers thought their home purchase was a better financial investment than stocks compared to 54% in 2009.  31% of buyers think their home purchase was "at least as good an investment as stocks." 

According to the Massachusetts Association of Realtors year-end figures, 2010 sales numbers of single family detached dwellings was down less than 2% while the median sale price increased approximately 4.3% from 2009.

Who Said it was a Buyer's Market?

Who said it was a buyer's market?  Often, when I speak with potential buyers, they enter the market expecting to get huge discounts on properties that are being marketed for sale or they're waiting for market values to drop further. Television, newspaper articles, and 'get rich schemes' marketed through the Internet and TV all tout the ease with which a person can buy for "pennies on the dollar". 

While a person can sometimes get a good deal, more often than not, in order to move from looking to buying you have to get realistic along the way. Not every "good deal" is a good deal.  Let's also consider that in order to purchase a home at this time, you typically need to be a cash buyer, a W2 employee with verifiable income, possess a solid credit history, and have an excellent FICO score.

So, let's take a closer look at what defines a Buyer's market.  A Buyer's market is when there are more properties for sale than people interested in buying them.  Buyers have more choices and less competition which typically results in lower prices.

There are plenty of bank-owned foreclosures being offered at bargain prices. Does this make it a Buyer's Market? What you may not be aware of is that you are competing against a very large group of purchasers who are just waiting for new properties to become available.  In most cases, the absurdly low list price is utilized to generate tremendous traffic on the property which drives the price significantly upwards.  Expect that multiple offers will be submitted to the lender - many of which are cash purchasers.  Does this scenario match the definition of a Buyer's Market? Nope!

To further analyze the purchase of a bargain basement property, let's also consider that the property is most likely being purchased "as is" and that unknown repair costs could exceed the fair market value.  So, proceed carefully and utilize the services of an experienced buyer agent who can counsel you on what constitutes a strong Purchase Agreement, help you compile repair estimates, and determine whether the market value of the home after repair is lower than, meets, or exceeds the expenses you've incurred in purchasing and re-habbing the property.

Well-priced homes combined with outstanding interest rates make this a great time to purchase a property. Don't get caught up in whether it's a buyer's market but focus instead on property that meets realistic goals.

You Can Stop Sweating Now - Homebuyer Tax Credit Extended

According to the National Association of Realtors®, up to 180,000 home buyers could lose their tax credit through no fault of their own.  These buyers met all the qualifications for the tax credit but delays and workflow jams with lenders prevented purchasers from completing their purchase prior to the June 30, 2010 deadline.

Down to the wire, Congress passed an extension of the Homebuyer Assistance and Improvement Act (H.R. 5623).  This extension only applies to transactions with ratified contracts in place as of April 30, 2010 which haven't closed yet.   The new closing deadline is September 30, 2010.

What does this mean to you?  Home buyers who meet the qualifications for the Homebuyer Assistance and Improvement Act have until September 30, 2010 to close on their property.  It also provides additional stability to the real estate market across the nation which is sorely needed.

Unemployed Need Not Apply

Yesterday, I was on the Yahoo Home page and an article titled "Out-of-work job applicants told unemployed need not apply" caught my eye.  The article references a growing trend of employers who will only interview candidates who are currently employed.  According to the article, some job postings include restrictions such as "unemployed candidates will not be considered" or "must be currently employed." What??? Can this be for real??? 

The thought process of companies not hiring "out of work job applicants" seems to be that they believe the job-seeker must've been laid off due to performance issues.  While I would agree that some workers probably were cut due to performance issues, the number of viable, highly skilled people seeking work is astronomical. Don't these companies realize that they hold the key to turning the economy around?  Paying jobs = paying the mortgage = less foreclosures and short sales.  Paying jobs = more spending = better economic conditions.  Hello!

A recently passed tax break, which essentially exempts firms that hire unemployed job seekers from paying the 6.2% of the new hire's wages in Social Security taxes for the rest of this year, might change their tune.  Let's hope so!
